Terms of Service

These Terms of Service (“Terms”) govern your use of Cadence (the “Service”), operated by True AI Ventures, LLC (“True AI Ventures,” “we,” “us,” or “our”), a Delaware limited liability company. By using the Service, you agree to these Terms.

Beta Stage Notice

Cadence is currently in a beta stage of development. This means:

• Features may be incomplete, may change significantly, or may be removed without notice.
• The Service may be interrupted, unavailable, or discontinued at any time.
• Routines, session history, and other data you create may be lost during updates. Do not rely on the Service as the sole record of anything important to you.
• We make no service-level commitments during the beta.

The Service

Cadence is a routine builder and timer for Pilates and similar workouts, available on the web, iPhone, and Apple Watch.

Early Access

Access to the beta is by invitation at our discretion and may be suspended or revoked at any time, with or without cause. If you provide feedback, suggestions, or bug reports, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
• Resell or redistribute the Service without our written permission.

Intellectual Property

The Service, including its design, software, and content, is owned by True AI Ventures, LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. You retain ownership of the routines and content you create.

Cadence is not a medical device and does not provide medical advice. See ourHealth & Fitness Disclaimer, which is incorporated into these Terms.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AS A BETA PRODUCT, THE SERVICE MAY CONTAIN ERRORS AND IS NOT GUARANTEED TO BE ACCURATE, RELIABLE, OR UNINTERRUPTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUE AI VENTURES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

Termination

We may suspend or terminate your access to the Service at any time during the beta. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time, particularly as the Service moves out of beta. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
